This project studies the full compensation of non-pecuniary damages in the EU from a comparative-empirical perspective.\n\nNon-pecuniary damages are non-economic losses that cannot be measured accurately in money. There is a concern in the literature that the awarding of such damages is fragmented and surrounded by bias.\n\nThe project aims to develop evidence-based guidelines for adjudicators and a model legislative proposal for the EU Member States to award non pecuniary damages in a way that reconciles equal treatment and personalisation.\n\nTo this end, the guidelines already used in the EU Member States to award non-pecuniary damages are comparatively reviewed. Further, empirical evidence is also gathered by analysing the case-law of selected national jurisdictions, interviewing adjudicators, and conducting stakeholder focus groups. This dataset contains the protocols of the empirical activities involved in the project."}}]},{"typeName":"subject","multiple":true,"typeClass":"controlledVocabulary","value":["Law"]},{"typeName":"keyword","multiple":true,"typeClass":"compound","value":[{"keywordValue":{"typeName":"keywordValue","multiple":false,"typeClass":"primitive","value":"Private Law"},"keywordVocabulary":{"typeName":"keywordVocabulary","multiple":false,"typeClass":"primitive","value":"THESOZ Thesaurus"},"keywordVocabularyURI":{"typeName":"keywordVocabularyURI","multiple":false,"typeClass":"primitive","value":"https://lod.gesis.org/thesoz/en/index"}},{"keywordValue":{"typeName":"keywordValue","multiple":false,"typeClass":"primitive","value":"Civil Law"},"keywordVocabulary":{"typeName":"keywordVocabulary","multiple":false,"typeClass":"primitive","value":"THESOZ Thesaurus"},"keywordVocabularyURI":{"typeName":"keywordVocabularyURI","multiple":false,"typeClass":"primitive","value":"https://lod.gesis.org/thesoz/en/index"}},{"keywordValue":{"typeName":"keywordValue","multiple":false,"typeClass":"primitive","value":"Compensation (Law)"},"keywordVocabulary":{"typeName":"keywordVocabulary","multiple":false,"typeClass":"primitive","value":"THESOZ Thesaurus"},"keywordVocabularyURI":{"typeName":"keywordVocabularyURI","multiple":false,"typeClass":"primitive","value":"https://lod.gesis.org/thesoz/en/index"}},{"keywordValue":{"typeName":"keywordValue","multiple":false,"typeClass":"primitive","value":"Compensation for personal injury or suffering"},"keywordVocabulary":{"typeName":"keywordVocabulary","multiple":false,"typeClass":"primitive","value":"THESOZ Thesaurus"},"keywordVocabularyURI":{"typeName":"keywordVocabularyURI","multiple":false,"typeClass":"primitive","value":"https://lod.gesis.org/thesoz/en/index"}},{"keywordValue":{"typeName":"keywordValue","multiple":false,"typeClass":"primitive","value":"Damages"},"keywordVocabulary":{"typeName":"keywordVocabulary","multiple":false,"typeClass":"primitive","value":"THESOZ Thesaurus"},"keywordVocabularyURI":{"typeName":"keywordVocabularyURI","multiple":false,"typeClass":"primitive","value":"https://lod.gesis.org/thesoz/en/index"}}]},{"typeName":"depositor","multiple":false,"typeClass":"primitive","value":"Wauters, Fieke"},{"typeName":"dateOfDeposit","multiple":false,"typeClass":"primitive","value":"2022-11-17"}]},"dansDataVaultMetadata":{"displayName":"Data Vault Metadata","name":"dansDataVaultMetadata","fields":[{"typeName":"dansDataversePid","multiple":false,"typeClass":"primitive","value":"doi:10.34894/RHHGVV"},{"typeName":"dansDataversePidVersion","multiple":false,"typeClass":"primitive","value":"3.0"},{"typeName":"dansBagId","multiple":false,"typeClass":"primitive","value":"urn:uuid:dfaac193-ece0-4c99-a8bf-ce2292f941f7"},{"typeName":"dansNbn","multiple":false,"typeClass":"primitive","value":"urn:nbn:nl:ui:13-6937c6eb-2db6-49e1-bc38-aeaf50d0c03a"}]}},"files":[{"description":"FullCompensation involves, first, a document analysis of the case-law of selected national jurisdictions in the EU.
